Terms and Conditions for Purchases from Better Independent Living

By placing an order with Better Independent Living, either online or offline, you agree to our terms and conditions outlined below. Please review these carefully and retain a copy for your records. These terms do not compromise your statutory rights. You must be 18 years or older to order from us. Each order is considered an offer by you to purchase under these terms.

Right to Refuse Sale

We reserve the right to refuse any order at our discretion.

Product Advice and Suitability

All purchases made from Better Independent Living are at the buyer's request. Due to the nature of remote transactions, we cannot guarantee the suitability of our products for your specific needs. It's your responsibility to ensure a product meets your requirements. We suggest consulting a qualified Occupational Therapist for advice on product suitability. Any guidance from our staff is general and should not be solely relied upon.

Product Descriptions and Liability

We ensure that our goods match their descriptions at the time of delivery. However, given the technical nature of our products, detailed specifications may not always be provided. Descriptions, images, and advertisements are intended for general information purposes. Specific product details should be confirmed with the manufacturer. Customer warranties beyond those implied by law for non-consumer transactions are excluded.

Pricing and Typographical Errors

We reserve the right to cancel or refuse orders for items listed at the incorrect price due to typographical errors or incorrect pricing information from suppliers.

Product Images and Specifications

While we strive for accuracy in our product images and specifications, discrepancies may occur. We cannot be held responsible for such errors, but we welcome notification to correct them.

Payment and Security

This website serves UK residents for delivery within the UK, accepting payments from UK credit cards. Your billing address and phone number must match the information your credit card issuer has on file. We conduct security checks to prevent fraud, which may involve third-party database validation. These checks are strictly to confirm identity and do not affect your credit rating. All personal information is handled in accordance with the Data Protection Act 1998.

Availability and Delivery

Products are subject to availability and may be withdrawn at any time. If a product is out of stock, we will contact you with the option to cancel the order. Delivery dates are not guaranteed and we are not liable for delays. Delivery charges are non-refundable for delays caused by adverse weather or other uncontrollable factors. Deliveries may be made in instalments.

Notification of Claims

Damaged items must be reported within 48 hours of delivery with packaging retained for inspection. Shortages and incorrect goods must also be reported within 48 hours. We handle claims for damages, shortages, and incorrect goods within these time frames.

Product Guarantees

All products come with the manufacturer's guarantee, in addition to your statutory rights. Some items with a limited lifespan are not covered by the 12-month warranty.

Faulty Goods

Faulty products may be referred to the manufacturer for expert assessment. If deemed faulty, replacements or repairs will be arranged. A restocking fee may apply for returned items found to be non-defective.

Liability

Our liability for breaches of these terms is limited to the purchase price of the goods. We are not liable for indirect or consequential damages except in cases of personal injury or death where the customer is acting as a consumer.

Force Majeure

We are not liable for delays or failures in delivery caused by events beyond our control.

General Provisions

No waiver of these terms by us shall be deemed a waiver of any subsequent breach. If any provision is deemed invalid, the remainder of the terms shall remain in effect. These terms are governed by English law.
